Terms of Service

Effective date: June 1, 2026

These Terms of Service ("Terms") are a binding agreement between you and GMOScan ("we," "us," or "our") and govern your access to and use of gmoscan.com, and our related mobile and web applications, including GMOScan.ai and GMOScan Kids (the "Service"). Please read them carefully.

By creating an account, installing the app, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Acceptance and changes

By using the Service you confirm that you can form a binding contract with us and that you accept these Terms. We may update these Terms from time to time. When changes are material we will update the effective date above and, where appropriate, provide additional notice in the Service. Your continued use after an update means you accept the revised Terms.

Who may use the Service

The Service is intended for a general audience. You must be at least the age of majority in your place of residence to create an account, or use the Service under the supervision of a parent or guardian who agrees to these Terms on your behalf. Our companion kids experience (GMOScan Kids) is provisioned and controlled by an adult account holder.

Your account

  • You are responsible for the activity that happens under your account and for keeping your sign-in credentials confidential.
  • Provide accurate information and keep it current. Notify us promptly of any unauthorized use of your account.
  • We may suspend or terminate accounts that violate these Terms or that we reasonably believe create risk or legal exposure.

Acceptable use

We want the Service to be safe and useful for everyone. You agree not to misuse it. In particular, you agree not to:

  • Post, upload, or share content that is unlawful, abusive, harassing, hateful, threatening, defamatory, obscene, sexually explicit, or otherwise objectionable.
  • Impersonate any person or entity, or misrepresent your affiliation with anyone.
  • Attempt to access, tamper with, or disrupt the Service, its security, or other users' data, including via scraping, reverse engineering, or automated abuse.
  • Use the Service to violate any law or the rights of others, or to transmit malware or spam.
  • Circumvent usage limits, entitlement checks, or payment requirements.

Community content and conduct

The Service includes community features where you may post comments, ratings, and photos ("User Content"). You retain ownership of your User Content, and you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display it solely to operate and improve the Service.

We enforce a zero-tolerance policy for objectionable content and abusive behavior. You can report content from within the feed, and we review reports and remove violating content and may suspend or block offending users. We may remove content or limit access at our discretion to keep the community safe.

  • Do not upload anything you do not have the right to share, or that you would not want made public.
  • Report objectionable content or abusive users using the in-app reporting controls.
  • Repeated or serious violations may result in removal of content and termination of access.

Memberships, billing, and renewals

Some features require a paid membership. Web purchases are processed by our payment processor (Stripe); purchases made through a mobile app store are processed and billed by that store under its own terms. Paid plans renew automatically for the applicable period until cancelled, and you authorize the recurring charge through the processor you signed up with.

  • You can cancel anytime; cancellation stops future renewals and access continues until the end of the current paid period.
  • Except where required by law or an app store's policy, payments are non-refundable.
  • We may change features or prices on a going-forward basis; we will give notice of material changes where required.
  • Manage or cancel app-store subscriptions through the store account you purchased from.

Educational use only — not medical advice

GMOScan is an educational tool. Reports are produced using automated and AI systems based on the information available and may be incomplete or inaccurate. The Service is not a medical device, lab test, or substitute for professional advice, and it is not suitable for diagnosing or managing life-threatening allergies or medical conditions. Always follow product labeling and consult your healthcare provider or allergist for medical decisions.

Intellectual property

The Service, including its software, design, text, and branding (excluding User Content and third-party materials), is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service in accordance with these Terms. You may not copy, modify, distribute, sell, or create derivative works from the Service except as expressly permitted.

Third-party services and data

The Service relies on third-party providers (for example, hosting, authentication, payment processing, AI analysis, and public product databases) and may link to third-party sites. We are not responsible for third-party services or content, and your use of them may be governed by their own terms and policies.

Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. Sections that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that reports will be accurate or complete.

Limitation of liability

To the maximum extent permitted by law, GMOScan and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

Indemnification

You agree to indemnify and hold harmless GMOScan and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, or your violation of these Terms or the rights of others.

Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict-of-laws rules. You agree to resolve disputes in the courts of that jurisdiction, except where applicable law gives you the right to bring claims elsewhere. Nothing in these Terms limits any non-waivable consumer rights you may have.
